    J Mac Botanicals Affiliate Program Terms and Conditions

    These J Mac Botanicals Affiliate Program Terms and Conditions (“Terms”) form a legally binding agreement between Waterglider LLC, doing business as J Mac Botanicals (“J Mac Botanicals,” “JMB,” “we,” “us,” or “our”), and the individual or legal entity accepted into the J Mac Botanicals Affiliate Program (“Affiliate,” “you,” or “your”).

    By submitting a Program application, checking a box indicating acceptance, accessing an approved affiliate account, using an affiliate link or code, or otherwise participating in the Program after approval, you acknowledge that you have read, understood, and agreed to these Terms.

    If you accept these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

    These Terms contain limitations of liability, indemnification obligations, and an exclusive Washington governing-law and venue provision. Please read them carefully.

    1. DEFINITIONS

    For purposes of these Terms:

    1.1 Affiliate Channels

    “Affiliate Channels” means the websites, blogs, social-media accounts, newsletters, podcasts, video channels, or other promotional channels identified in your application or subsequently approved by JMB.

    1.2 Applicable Offer and Offer Terms

    “Applicable Offer” means the Refersion commission offer to which the affiliate is assigned from time to time. 

    “Offer Terms” means the commission rate, commission type, eligible products or product categories, campaign period, bonus terms, and other compensation terms displayed to or otherwise provided in writing to the Affiliate in connection with the Applicable Offer.

    The Offer Terms are incorporated by reference into these Terms.

    1.3 Brand Materials

    “Brand Materials” means affiliate links, promotional codes, product photographs, videos, graphics, logos, trademarks, product descriptions, approved claims, written copy, banners, and other materials that JMB provides or expressly approves for Program use.

    1.4 Conversion Date

    “Conversion Date” means the date and time on which a qualifying customer order is recorded as a conversion in Refersion.

    1.5 Qualifying Order

    A “Qualifying Order” is a genuine, arm’s-length customer purchase that:

    is placed through the J Mac Botanicals online store using a supported checkout method;

    is attributed to the Affiliate by Refersion or approved by JMB;

    is completed using valid payment;

    complies with these Terms and all applicable customer policies; and

    has not been cancelled, refunded, returned, charged back, identified as fraudulent, or otherwise determined to be ineligible.

    1.6 Qualifying Revenue

    “Qualifying Revenue” means the amount charged for eligible products in a Qualifying Order after discounts and promotional credits have been applied.

    Qualifying Revenue does not include:

    Sales, use, or similar taxes

    Shipping or handling charges

    Gift-card purchases

    Gratuities, donations, or other non-product amounts

    Amounts refunded, credited, cancelled, or charged back

    Products specifically identified by JMB as excluded from commissions

    1.7 Program

    “Program” means the J Mac Botanicals Affiliate Program administered through Refersion.

    1.8 Site

    “Site” means the J Mac Botanicals online store and associated webpages through which qualifying customer orders are placed.

    1.9 Written Approval

    “Written Approval” means approval provided by an authorized JMB representative through email, Refersion, or another written communication. Silence, past inaction, or approval of unrelated content does not constitute Written Approval.

    2. ELIGIBILITY AND APPLICATION

    2.1 U.S.-Only Program

    The Program is open only to:

    individuals who are at least 18 years old, maintain their primary residence in one of the 50 United States or the District of Columbia, and primarily conduct their affiliate activities from an eligible U.S. location; and

    legal entities organized under the laws of the United States or one of its states, with a principal place of business and primary affiliate operations in one of the 50 United States or the District of Columbia.

    For purposes of these Terms, Puerto Rico and other U.S. territories are not included unless JMB expressly approves them in writing in the future.

    2.2 Accurate Application Information

    You must provide complete, current, and accurate application information, including your identity, address, contact information, business or creator name, and primary website or social-media channel.

    You must promptly update your information if it changes. Material misrepresentations, omitted information, false audience statistics, fake engagement, or inaccurate location information are grounds for rejection, suspension, or termination.

    2.3 Application Review

    JMB may approve or reject any application in its reasonable business discretion, subject to applicable law. Submission of an application does not guarantee acceptance.

    JMB is not required to provide a detailed explanation for rejecting an application.

    2.4 Approval Is Applicant-Specific

    Approval applies only to the individual or entity named in the application and to the Affiliate Channels reviewed or approved by JMB.

    An approved account may not be sold, assigned, shared, or transferred. Agencies, networks, managers, or other parties may not enroll undisclosed creators or sub-affiliates under one account without Written Approval.

    2.5 Account Security

    You are responsible for protecting your Refersion login credentials and for all activity conducted through your account.

    You must notify JMB and Refersion promptly if you suspect unauthorized access, credential theft, or misuse of your account.

    3. PROGRAM DESCRIPTION AND RESPONSIBILITIES

    3.1 Affiliate Activities

    The Program permits approved Affiliates to promote J Mac Botanicals through approved Affiliate Channels and to earn commissions on Qualifying Orders attributed to them.

    Participation is non-exclusive. JMB does not require you to promote J Mac Botanicals exclusively, provided that your other activities do not create confusion, misuse JMB Confidential Information, or result in false or misleading comparisons.

    3.2 Tools Provided by JMB

    JMB may provide:

    Affiliate links

    Refersion dashboard access

    Promotional codes

    Product information

    Approved photographs and graphics

    Brand or disclosure guidance

    Campaign information

    Other promotional resources

    JMB is not required to provide any particular asset, product sample, promotional code, discount, or campaign opportunity.

    3.3 Affiliate Responsibilities and Costs

    You are solely responsible for:

    Creating and maintaining your Affiliate Channels

    Producing your content

    Paying your operating and promotional expenses

    Obtaining necessary equipment, software, licenses, and permissions

    Complying with applicable laws and platform rules

    Confirming that product, pricing, and promotional information remains current

    Unless separately agreed in writing, JMB will not reimburse you for products, advertising, content production, travel, software, contractors, or other expenses.

    3.4 JMB Controls Customer Transactions

    JMB remains the merchant of record for purchases made through the Site. JMB controls:

    Product prices and availability

    Checkout and payment processing

    Customer acceptance or rejection

    Shipping and fulfillment

    Returns, refunds, credits, and cancellations

    Customer service

    Site policies

    The handling of customer information under applicable privacy notices

    You have no authority to accept orders, collect customer payments, issue refunds, make warranties, alter JMB policies, or bind JMB to any obligation.

    4. COMMISSIONS AND COMMISSIONABLE REVENUE

    4.1 Applicable Commission Rate

    Subject to these Terms, the Affiliate may earn commissions at the rate and according to the commission type stated in the Affiliate’s Applicable Offer.

    The exact commission rate is established by the Applicable Offer and is not permanently fixed by these Program Terms. JMB may maintain different offers for different affiliates, campaigns, product categories, or promotional arrangements.

    No commission rate, bonus, or special compensation arrangement applies unless it is stated in the Applicable Offer or separately confirmed by JMB in writing.

    4.2 Commission Calculation

    Unless the Applicable Offer expressly states otherwise, a percentage-based commission will be calculated on Qualifying Revenue.

    A Qualifying Order may include more than one eligible product. When an order qualifies, the Affiliate’s commission will be calculated on the Qualifying Revenue attributable to all eligible products in the qualifying cart, rather than only the product featured in the Affiliate’s content or reached through the Affiliate’s referral link.

    4.3 Excluded Amounts

    Qualifying Revenue does not include:

    Sales, use, or similar taxes;

    Shipping or handling charges;

    Gift-card purchases;

    Gratuities, donations, or other non-product amounts;

    Amounts cancelled, refunded, returned, credited, or charged back;

    Products or product categories expressly excluded in the Applicable Offer; or

    Other amounts expressly identified as non-commissionable in these Terms or the Applicable Offer.

    4.4 Multiple Customer Orders

    More than one order from the same customer may qualify when Refersion attributes each order to the Affiliate and each order independently satisfies these Terms.

    Participation in the Program does not create a lifetime commission right. Each order must independently qualify under the attribution method, Attribution Window, Applicable Offer, and Program rules in effect for that order.

    4.5 Relationship Between Offer Terms and Program Terms

    If the Offer Terms conflict with these Program Terms, the Offer Terms will control only with respect to the commission rate, commission type, eligible products or categories, campaign period, bonus, or other compensation detail expressly addressed by the Offer Terms.

    These Program Terms will control with respect to all other matters, including Affiliate eligibility, attribution requirements, prohibited conduct, commission validation, returns, reversals, payment administration, intellectual property, termination, and dispute resolution.

    4.6 No Guaranteed Earnings

    JMB does not guarantee any number of clicks, referrals, purchases, conversions, commissions, sales, earnings, product samples, campaigns, or promotional opportunities.

     

    5. ATTRIBUTION

    5.1 Ninety-Day Link Attribution Window

    The Program uses a 90-day Attribution Window for qualifying affiliate-link referrals.

    A customer purchase may be attributed to an Affiliate when the purchase occurs within 90 days after the customer’s qualifying click on that Affiliate’s approved referral link, subject to these Terms and Refersion’s tracking capabilities.

    5.2 Last-Touch Attribution

    Affiliate-link attribution generally operates on a last-touch basis. When a customer clicks links associated with multiple affiliates, the most recent qualifying affiliate-link click generally receives link attribution.

    5.3 Other Attribution Methods

    JMB may approve other attribution methods, including promotional codes or other methods supported by Refersion.

    Those methods may not be subject to the 90-day link-attribution window and may operate under different attribution rules. Attribution priority among links, codes, and other approved methods will be determined by the applicable Refersion configuration and JMB’s reasonable good-faith interpretation of Program records.

    5.4 Tracking Limitations

    Affiliate tracking may be affected by:

    Use of different devices or browsers

    Private or incognito browsing

    Deleted or altered browser data

    Browser privacy settings

    Ad-blocking or tracking-prevention technology

    Network, platform, integration, or checkout errors

    Customer use of another Affiliate’s link or code

    Customer failure to complete checkout through a supported method

    Other technical circumstances outside JMB’s reasonable control

    JMB does not guarantee that every click, visit, or purchase will be successfully tracked.

    5.5 Refersion Records

    Refersion’s records will be presumed accurate unless JMB identifies a clear error.

    An Affiliate who believes a transaction was not properly tracked must notify JMB within 30 days after the expected transaction date or dashboard entry and provide available information supporting the inquiry.

    JMB may be unable to disclose customer-identifying information when investigating an attribution question. JMB’s good-faith determination concerning attribution and commission eligibility will be final, subject to applicable law.

    6. COMMISSION REVIEW, APPROVAL, AND REVERSALS

    6.1 Pending Status

    A tracked conversion does not create an immediately payable commission.

    Conversions may remain pending while JMB verifies:

    Valid payment

    Fulfillment status

    Attribution

    Return or cancellation status

    Compliance with these Terms

    Absence of fraud, self-dealing, or misuse

    6.2 Reasons for Denial or Reversal

    A commission may be denied, reduced, or reversed when an order:

    Is cancelled

    Is fully or partially refunded

    Is returned

    Is subject to a payment dispute or chargeback

    Uses invalid, stolen, or unsuccessful payment

    Is fraudulent or reasonably suspected of fraud

    Is a duplicate, test, or accidental order

    Is a self-referral

    Results from prohibited advertising or attribution manipulation

    Uses an unauthorized or improperly distributed promotional code

    Was placed in violation of these Terms

    Was not fulfilled

    Was attributed because of a technical or administrative error

    Otherwise fails to qualify

    A partial refund or credit may result in a proportional commission adjustment.

    6.3 Reversals After Payment

    If a commission is paid and the related order later becomes ineligible, JMB may:

    Deduct the amount from future commissions

    Correct the Affiliate’s account balance

    Request repayment

    Use another lawful method to recover an overpayment

    6.4 Investigation Holds

    JMB may temporarily withhold approval or payment while investigating suspected fraud, policy violations, payment problems, attribution errors, chargebacks, or other legitimate concerns.

    No interest accrues on pending, withheld, adjusted, or disputed commissions.

    7. UNIFIED PAYMENTS

    7.1 Required Payment Platform

    Program commissions will be administered through Refersion Unified Payments unless JMB designates another payment method in writing.

    To receive payment, an Affiliate must complete all applicable Refersion and Unified Payments requirements, which may include:

    Creating or maintaining a Refersion Marketplace account

    Accepting provider terms

    Completing identity verification

    Verifying a telephone number or email address

    Submitting tax information

    Connecting an eligible payout method

    Completing other compliance requirements

    7.2 Payment Schedule

    Under the current Unified Payments schedule, eligible approved commissions are generally deposited into an Affiliate’s Unified Payments Wallet on or around the 10th day of the applicable month.

    Payment timing remains subject to:

    Commission approval

    Required transaction-aging periods

    Refersion and Unified Payments processing

    Banking schedules

    Affiliate onboarding status

    Funding or technical delays

    Compliance reviews

    Other provider requirements

    JMB does not guarantee that a payment will arrive on an exact calendar date.

    7.3 No Separate JMB Minimum

    JMB does not currently impose a separate minimum commission balance before eligible approved commissions are sent through Unified Payments.

    Refersion, Dots, banks, wallet providers, or other payment providers may apply their own withdrawal thresholds, timing rules, verification requirements, or fees.

    7.4 U.S. Dollars and Provider Fees

    All commissions are calculated and paid in U.S. dollars.

    The Affiliate is responsible for withdrawal fees, account fees, transfer fees, or other charges imposed by Refersion, Dots, banks, wallet providers, or the Affiliate’s selected payout method.

    7.5 Failure to Complete Payment Setup

    Payment may be delayed or held if the Affiliate fails to provide accurate identity, tax, or payout information or fails to complete required onboarding.

    JMB may suspend or terminate an Affiliate who does not complete required payment onboarding within a reasonable period after notice. Unclaimed amounts will be handled in accordance with applicable law and provider requirements.

    7.6 Third-Party Payment Services

    Refersion, Dots, and other payment providers operate under their own terms and privacy notices. JMB is not responsible for a provider’s independent account decision, identity-verification decision, withdrawal restriction, processing error, fee, outage, or delay, although JMB may reasonably assist with inquiries concerning commissions it submitted.

    8. SELF-REFERRALS, FRAUD, AND ARTIFICIAL ACTIVITY

    8.1 No Self-Referrals

    You may not earn a commission on an order that you place, fund, control, direct, reimburse, or materially participate in placing.

    Prohibited self-referrals include orders placed:

    For your personal use

    For samples

    For resale

    For your business

    Using your own payment method

    By an employee, agent, contractor, or other person acting at your direction

    By another person whom you reimburse or compensate for placing the order

    To manufacture a commission or meet a performance target

    Shared household information alone is not necessarily conclusive, but JMB may investigate any order reasonably suggesting self-dealing.

    8.2 No Fraudulent or Artificial Activity

    You may not:

    Generate automated or bot clicks

    Use click farms or conversion farms

    Submit fake orders

    Use stolen payment information

    Misrepresent audience size or engagement

    Purchase fake followers or engagement to mislead JMB

    Coordinate transactions designed primarily to create commissions

    Use multiple accounts to evade Program rules

    Manipulate refunds, chargebacks, or customer identities

    Engage in any other fraudulent or deceptive activity

    JMB may withhold commissions and suspend an account during an investigation.

    9. FTC DISCLOSURES AND ENDORSEMENTS

    9.1 Material-Connection Disclosure

    Every endorsement or promotional communication must clearly and conspicuously disclose the Affiliate’s material relationship with JMB whenever disclosure is required by law.

    A material relationship includes the opportunity to earn commissions and the receipt of free or discounted products, samples, services, gifts, or other benefits.

    9.2 Clear Placement

    A disclosure must:

    Be easy to notice, read, and understand

    Appear with the endorsement itself

    Be placed before or near the affiliate link or recommendation

    Not be hidden in a profile, biography page, terms page, or long list of hashtags

    Not require a viewer to click “more” to find it

    Be in the same language as the endorsement

    Remain visible long enough to be read

    A disclosure such as the following will generally be appropriate when it accurately describes the relationship:

    This post contains J Mac Botanicals affiliate links. I may earn a commission if you purchase through my links.

    Depending on context, a clearly placed term such as #ad or #sponsored may also be appropriate. Vague terms such as “collab,” “partner,” “ambassador,” or “thanks” should not be used alone when they do not clearly communicate the financial relationship.

    9.3 Video, Audio, and Live Content

    For video content, the disclosure should ordinarily appear both visually and audibly near the beginning of the endorsement and before a viewer is directed to purchase.

    For live content, the disclosure must be repeated periodically so that viewers joining later are likely to receive it.

    A platform’s branded-content or paid-partnership tool may be used, but the Affiliate may not rely on the platform tool alone when an additional disclosure is needed to make the relationship clear.

    9.4 Truthful Experience

    You must express your honest opinions and actual experiences.

    You may not:

    Claim to have used a product you have not used

    Misrepresent your experience

    Say that you liked a product if that is not true

    Fabricate a customer or professional testimonial

    Use fake reviews or testimonials

    Create a false consumer persona

    Condition a review incentive on positive sentiment

    Present AI-generated people, voices, or content as genuine customer experiences

    Make claims for which JMB does not have adequate support

    FTC guidance says financial and free-product relationships should be disclosed clearly and close to the endorsement; it also states that influencers may not claim product experiences they did not have or invent unsupported health claims. The FTC’s Consumer Reviews and Testimonials Rule separately addresses fake or false testimonials and incentives conditioned on positive reviews.

    10. PRODUCT CLAIMS AND RESPONSIBLE BOTANICAL CONTENT

    10.1 Approved Claims Only

    You may use product facts and claims contained in current JMB-approved Brand Materials or current JMB product pages, provided that you quote or paraphrase them accurately and retain material qualifications.

    You may not enlarge, strengthen, or materially alter an approved claim.

    10.2 No Disease or Drug Claims

    Unless JMB has expressly approved specific language in writing, you may not state or imply that a JMB product:

    Diagnoses a disease or medical condition

    Treats a disease or medical condition

    Cures a disease or medical condition

    Prevents a disease or medical condition

    Replaces medication or professional medical treatment

    Guarantees a health outcome

    Is clinically proven or medically proven

    Has no side effects

    Is safe for every person

    Is FDA approved

    Is recommended by a physician or other professional when that is not documented and authorized

    You may not use images, before-and-after presentations, product names, hashtags, testimonials, or surrounding content to imply a prohibited claim indirectly.

    FDA guidance distinguishes permitted food or supplement claims from claims that a product diagnoses, treats, cures, or prevents disease.

    10.3 No Individualized Medical Advice

    You may discuss your genuine personal experience, subject to these Terms, but you may not diagnose another person, prescribe a product, advise a person to stop treatment, or present yourself as speaking on JMB’s behalf.

    Professional credentials must be described truthfully and may not be used to imply JMB endorsement or clinical proof.

    10.4 Organic, Sourcing, and U.S. Claims

    You may use “organic,” certification, origin, sourcing, sustainability, manufacturing, or packaging claims only when the claim is accurate for the specific product and appears in current approved JMB materials.

    In particular, you may not:

    Describe a product as certified organic when it is not

    Imply that every JMB product has the same certification

    State or imply that globally sourced ingredients were grown in the United States merely because they were packaged in the United States

    State that JMB has direct farm relationships for a particular product unless JMB has approved that statement

    Make unsupported “fair trade,” “sustainable,” “ethical,” “chemical-free,” “non-toxic,” or similar claims

    10.5 Intended Use

    You must follow the product’s current label, directions, cautions, and intended-use information.

    You may not recommend ingesting a product that is labeled or sold only for cosmetic or external use. You may not portray a tea, herb, cosmetic oil, or other product as a drug or for a use that JMB has not authorized.

    10.6 Recipes, Formulations, and DIY Content

    Affiliate-created recipes, cosmetic formulations, tea blends, or DIY instructions must be accurate, lawful, and reasonably safe.

    Unless JMB has approved the content in writing, you must not state or imply that:

    JMB developed the recipe or formulation

    JMB tested it

    JMB guarantees its results

    JMB approved its safety

    It represents official JMB directions

    You remain responsible for instructions, ingredient quantities, third-party ingredients, cautions, and claims in your independently created content.

    10.7 Prices, Discounts, and Availability

    You must confirm that any price, discount, free-shipping offer, product size, stock status, or deadline remains current before publishing or repeating it.

    You must promptly correct or remove expired or inaccurate promotional information.

    11. PROMOTIONAL RESTRICTIONS

    Unless JMB gives prior Written Approval, the following activities are prohibited.

    11.1 Unlawful or Brand-Unsafe Content

    You may not promote JMB through content or channels that contain or promote:

    Illegal activity

    Fraud or deception

    Hate, harassment, or unlawful discrimination

    Sexually explicit or pornographic material

    Violence or threats

    Dangerous misuse of products

    Counterfeit goods

    Malware or malicious software

    Unsupported health or safety claims

    Content reasonably likely to cause material harm to JMB’s reputation

    You may not falsely disparage competitors or make unsupported comparative claims.

    11.2 Impersonation

    You may not:

    Claim to be JMB

    Claim to be an employee, agent, official representative, or authorized spokesperson

    Use “official” or similar wording that creates confusion

    Operate an account or webpage that appears to be owned by JMB

    Make commitments or warranties on JMB’s behalf

    Respond to customers as JMB customer service

    You must clearly identify yourself as an independent Affiliate where context could otherwise create confusion.

    11.3 Trademark Bidding and Paid Search

    You may not bid on or purchase JMB-branded keywords or confusing variations, including:

    J Mac Botanicals

    J Mac

    Waterglider

    The JMB Site domain

    Product names uniquely associated with JMB

    Common misspellings or close variants

    Brand terms combined with words such as “coupon,” “discount,” “promo code,” or “sale”

    You may not use JMB trademarks in paid-search ad copy, display URLs, hidden keywords, or metadata in a manner likely to imply that an advertisement is operated by JMB.

    Direct linking from paid-search advertising to the Site requires Written Approval.

    11.4 Paid Social and Other Advertising

    Using JMB trademarks, Brand Materials, or affiliate links in paid social-media advertising, display advertising, native advertising, sponsored placements, or boosted content requires Written Approval.

    Written Approval of one advertisement does not approve future advertisements.

    11.5 Domain Names, Social Handles, and Applications

    You may not register, purchase, or use a domain name, subdomain, social-media username, application name, business name, or account name that contains or confusingly resembles JMB trademarks.

    11.6 Coupon, Deal, Cashback, and Loyalty Promotion

    Unless specifically approved, you may not operate or use:

    Coupon or deal websites

    Cashback programs

    Loyalty or reward programs

    Points programs

    Browser extensions

    Shopping toolbars

    Rebate sites

    Coupon databases

    Automated discount-code applications

    You may not advertise a coupon or discount that does not exist or imply that a customer must click an affiliate link to reveal an offer when no exclusive offer is available.

    11.7 Unauthorized Promotional Codes

    You may promote only codes that JMB has assigned or expressly authorized for you.

    You may not:

    Alter a code

    Create a code that has not been issued

    Promote an expired code

    Post a code on an unauthorized coupon site

    Claim that a public JMB discount is exclusive to you

    Purchase paid-search ads for a code

    Encourage customers to combine codes in violation of Site rules

    If a code is leaked or distributed outside its approved channels, JMB may disable it and deny or reassign resulting conversions when reasonably appropriate.

    11.8 Attribution Manipulation

    A customer must intentionally interact with the Affiliate’s promotional content or link.

    You may not use:

    Forced clicks

    Invisible frames

    Automatic redirects

    Pop-unders designed to trigger attribution

    Attribution stuffing

    Automatic link activation

    Adware

    Malware

    Software that intercepts traffic

    11.9 JMB-Owned Channels

    You may not place affiliate links or codes in:

    JMB social-media posts or comments

    JMB product-review sections

    JMB customer-service communications

    JMB advertising comments

    JMB-owned community pages

    Other channels controlled by JMB

    unless JMB expressly requests or approves that placement.

    11.10 Email Marketing

    You may promote JMB to your own permission-based email audience, provided that all messages comply with applicable law.

    You may not:

    Use purchased, rented, harvested, or scraped email lists

    Send unsolicited bulk email

    use false sender or routing information

    use deceptive subject lines

    imply that an email was sent by JMB

    omit required advertising disclosures

    omit a valid physical postal address

    omit a functional unsubscribe method

    fail to honor opt-out requests

    send to recipients who have withdrawn permission

    FTC guidance states that commercial email rules apply beyond bulk email and require accurate headers, non-deceptive subject lines, advertising identification, a physical postal address, and a working opt-out method.

    11.11 Text Messages and Telephone Calls

    Affiliate marketing through text messages, automated calls, prerecorded messages, or telemarketing requires prior Written Approval from JMB.

    The Affiliate must independently obtain and document all consents required by applicable federal and state law. An existing customer relationship, social-media follow, or email subscription does not by itself establish consent for marketing texts or calls.

    11.12 Giveaways and Promotions

    You may not conduct a contest, giveaway, sweepstakes, raffle, product bundle, or similar promotion involving JMB without Written Approval.

    Approved promotions must have legally sufficient rules, eligibility terms, disclosures, and platform notices. You may not state that JMB sponsors a promotion unless JMB has agreed in writing to be a sponsor.

    11.13 Resale and Marketplace Listings

    Program participation does not authorize you to act as a reseller, distributor, wholesaler, or marketplace seller.

    You may not list JMB products for resale on Amazon, eBay, Walmart Marketplace, Etsy, Facebook Marketplace, or another third-party marketplace under the Program without a separate written resale agreement.

    11.14 Sub-Affiliate Networks

    You may not distribute your affiliate link through a sub-affiliate network, agency network, lead-generation network, or undisclosed third-party publisher without Written Approval.

    You are responsible for anyone acting through your account or at your direction.

    12. CUSTOMER COMMUNICATIONS AND PRODUCT-SAFETY MATTERS

    12.1 Customer Questions

    You may share publicly available product information but may not promise:

    Refunds

    Replacements

    Delivery dates

    Product availability

    Medical results

    Special pricing

    Exceptions to JMB policies

    Customer questions about orders, shipping, returns, payments, product defects, or official product information should be directed to JMB.

    12.2 Safety and Adverse-Experience Reports

    If you receive a report concerning a serious adverse reaction, illness, injury, contamination, product defect, mislabeling, or other significant safety concern involving a JMB product, you must forward the report to JMB promptly and, when practicable, within 24 hours.

    You must not provide medical advice, make admissions on JMB’s behalf, promise compensation, or alter the substance of the customer’s report.

    12.3 Recalls and Corrective Instructions

    You must promptly follow any JMB instruction to stop promoting a product, remove or correct content, communicate approved safety information, or cooperate with a recall or corrective action.

    13. BRAND MATERIALS, TRADEMARKS, AND INTELLECTUAL PROPERTY

    13.1 Limited License

    During your approved participation, JMB grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use approved Brand Materials solely to promote JMB in accordance with these Terms.

    13.2 Permitted Modifications

    You may resize Brand Materials as reasonably necessary, provided that you do not:

    Distort them

    Remove notices

    Alter logos

    Change product colors materially

    Change their meaning

    Add unapproved claims

    Create a misleading impression

    Cropping, editing, translation, or other modification that could change meaning requires Written Approval.

    13.3 Ownership

    JMB and its licensors retain all ownership rights in Brand Materials, trademarks, product photographs, website content, trade dress, and other intellectual property.

    No ownership transfers to the Affiliate. All goodwill arising from use of JMB trademarks benefits JMB.

    13.4 Prohibited Intellectual-Property Uses

    You may not:

    Register or attempt to register a JMB trademark

    Challenge JMB’s rights

    Use a confusingly similar logo

    Incorporate a JMB mark into your business name

    Create merchandise using JMB marks

    Sell or sublicense Brand Materials

    Use Brand Materials after permission is withdrawn

    Use third-party content without appropriate rights

    13.5 Removal

    You must remove or stop using specified Brand Materials promptly upon request and must stop using all Brand Materials following termination, except to the extent JMB authorizes otherwise in writing.

    14. AFFILIATE CONTENT AND CONTENT LICENSE

    14.1 Affiliate Ownership

    Except for Brand Materials and other third-party content, you retain ownership of original content you create.

    14.2 Organic Repost License

    When you directly submit content to JMB for possible use, upload content through a JMB campaign, or expressly invite JMB to reshare content by tagging an official JMB account in a manner that reasonably indicates permission to repost, you grant JMB a non-exclusive, worldwide, royalty-free license to:

    Resize

    Crop

    Caption

    Archive

    that content on JMB-owned social-media accounts, websites, newsletters, and other organic brand channels during the Program and for 12 months afterward.

    JMB will not materially change the substance of your endorsement and will provide reasonable attribution where practicable.

    Mere use of an affiliate link, without submission, tagging, or another indication of permission, does not grant JMB a license to all content on your channel.

    14.3 Paid Advertising and Whitelisting

    JMB must obtain separate written permission before using Affiliate-created content in:

    Paid advertising

    Whitelisted advertising

    Paid boosting through the Affiliate’s account

    Packaging

    Third-party retail advertising

    Materially edited campaigns

    Uses extending beyond the license above

    14.4 Affiliate Representations

    You represent that:

    You created the content or have sufficient rights to it

    You have permission from recognizable people appearing in it

    You have the necessary rights to music, images, video, fonts, and other elements

    JMB’s permitted use will not infringe another person’s rights

    The content complies with law and these Terms

    15. CONFIDENTIALITY

    15.1 Confidential Information

    “Confidential Information” means nonpublic information disclosed by or on behalf of JMB, including:

    Unannounced products

    Future campaigns

    Embargoed launch information

    Nonpublic commission or performance data

    Business plans

    Supplier information

    Security information

    Nonpublic customer information

    Financial information

    Other information reasonably understood to be confidential

    15.2 Confidentiality Obligations

    You must:

    Use Confidential Information only for Program participation

    Protect it with reasonable care

    Limit access to people who legitimately need it and are bound by equivalent obligations

    Not disclose it without Written Approval

    Promptly notify JMB of unauthorized access or disclosure

    15.3 Exclusions

    Confidential Information does not include information that you can document:

    Was publicly available through no breach by you

    Was lawfully known to you without a confidentiality duty

    Was independently developed without use of JMB Confidential Information

    Was lawfully received from a third party without restriction

    15.4 Legally Required Disclosure

    If disclosure is legally required, you must provide JMB with prompt notice when permitted and disclose only the information legally required.

    15.5 Duration

    Confidentiality obligations continue for three years after termination. Obligations concerning trade secrets continue for as long as the information qualifies as a trade secret under applicable law.

    16. PRIVACY AND DATA SECURITY

    16.1 Affiliate Privacy Responsibilities

    You are independently responsible for personal information you collect through your Affiliate Channels.

    You must:

    Maintain an appropriate privacy notice

    Obtain legally required consent

    Use personal information only for disclosed lawful purposes

    Protect it with reasonable security measures

    Honor applicable privacy rights

    Follow platform and marketing-consent requirements

    Avoid collecting unnecessary sensitive information

    16.2 No Right to Customer Data

    Program participation does not give you ownership of or access to JMB customer records.

    You may not attempt to obtain, scrape, infer, purchase, or use JMB customer information except for information independently and lawfully provided directly to you for your own disclosed purpose.

    16.3 Security Incidents

    You must notify JMB promptly, and when practicable within 48 hours, after discovering unauthorized access, disclosure, loss, or misuse involving:

    Program credentials

    Affiliate links or codes

    Personal information collected in connection with your JMB promotions

    Information that could create a material risk to JMB or its customers

    16.4 Applicable Privacy Notices

    JMB’s collection and use of Program-related personal information is described in the J Mac Botanicals Affiliate Program Privacy Notice.

    Refersion, Unified Payments, Dots, and other providers may process information under their own privacy notices and terms.

    17. MONITORING AND CORRECTIVE ACTION

    JMB may review publicly available Affiliate content and may request:

    URLs

    Screenshots

    Copies of promotions

    Disclosure examples

    Traffic-source information

    Information concerning suspected violations

    Confirmation that content has been corrected or removed

    You must reasonably cooperate with Program compliance reviews.

    JMB may require content to be corrected, paused, or removed. Unless a shorter period is reasonably necessary because of legal, safety, or reputational risk, you must comply within 24 hours after receiving the request.

    JMB’s decision not to object to particular content does not waive these Terms or constitute approval of future content.

    18. INDEPENDENT CONTRACTOR AND TAXES

    18.1 Independent Relationship

    The Affiliate is an independent contractor.

    Nothing in these Terms creates:

    Employment

    Agency

    Partnership

    Joint venture

    Franchise

    Fiduciary relationship

    Exclusive representation

    You have no authority to bind JMB or act on its behalf.

    18.2 Control of Work

    Subject to these Terms, you control the time, place, manner, and means of your promotional activities.

    You are responsible for your own personnel, contractors, equipment, insurance, expenses, licenses, and business operations.

    18.3 Taxes

    You are responsible for:

    Reporting commission income

    Paying applicable federal, state, and local taxes

    Maintaining tax records

    Providing accurate tax forms and taxpayer information

    Obtaining professional tax advice when appropriate

    JMB, Refersion, or a payment provider may withhold amounts or report payments when legally required.

    Participation does not entitle you to wages, benefits, unemployment insurance, workers’ compensation, retirement benefits, expense reimbursement, or other employee benefits.

    19. TERM, SUSPENSION, AND TERMINATION

    19.1 Term

    These Terms begin when JMB approves your application and continue until terminated.

    19.2 Termination Without Cause

    Either party may terminate participation at any time by written notice.

    19.3 Immediate Suspension or Termination

    JMB may immediately suspend or terminate an account when it reasonably believes that the Affiliate:

    Breached these Terms

    Made false or misleading claims

    Failed to make required disclosures

    Engaged in fraud or self-dealing

    Used prohibited promotional methods

    Misused intellectual property

    Created legal, regulatory, security, or reputational risk

    Failed to complete payment or identity verification

    Provided inaccurate application information

    Failed to comply with a correction or takedown request

    Is no longer eligible for the Program

    Engaged in conduct materially inconsistent with JMB’s brand or customer interests

    19.4 Effect of Suspension

    During suspension, JMB may disable links or codes, pause access, withhold commission approval, and investigate relevant activity.

    19.5 Effect of Termination

    Upon termination, you must:

    Stop representing yourself as a JMB Affiliate

    Stop using affiliate links and promotional codes

    Remove JMB trademarks and Brand Materials from active promotional placements

    Stop using Confidential Information

    Comply with outstanding correction, privacy, and safety obligations

    19.6 Commissions Following Termination

    Subject to review and reversal rights:

    A valid Qualifying Order completed before the effective termination date may remain eligible.

    An order completed after the effective termination date is not commissionable, even if a customer clicked an affiliate link before termination, unless JMB agrees otherwise in writing.

    A commission arising from or materially affected by fraud, self-dealing, prohibited conduct, or another material breach may be denied or reversed.

    Unrelated valid commissions already earned will not be forfeited solely because the relationship ended.

    19.7 Survival

    Sections concerning payment adjustments, taxes, intellectual property, content licensing for its stated duration, confidentiality, privacy, indemnification, limitation of liability, disputes, and miscellaneous provisions survive termination.

    20. CHANGES TO THE PROGRAM OR THESE TERMS

    20.1 Changes to Terms

    JMB may update these Terms to reflect changes in:

    The Program

    Commission administration

    Refersion or payment services

    Law or regulatory guidance

    Products or promotional practices

    Security or fraud risks

    Business operations

    JMB will ordinarily provide at least 30 days’ notice before a material change takes effect.

    Changes reasonably necessary to address law, fraud, security, platform requirements, product safety, or misuse may take effect sooner.

    20.2 Changes to Offers and Commission Rates

    JMB may create, amend, replace, or discontinue an offer and may assign an Affiliate to a different offer, subject to these Terms and applicable law.

    JMB will provide reasonable advance notice before a reduction in an Affiliate’s commission rate or another material narrowing of commission eligibility. Unless a different period is stated in the notice, JMB will ordinarily provide at least 30 days’ advance notice of such a change.

    An increase in commission, a new bonus opportunity, or another change that is favorable to the Affiliate may take effect immediately.

    JMB may make a change on shorter notice when reasonably necessary to comply with law, address fraud or Program abuse, respond to a security or platform issue, correct an administrative error, discontinue a product, or protect JMB, its customers, or its Affiliates.

    Unless the applicable notice expressly states otherwise, a commission change will apply only to Qualifying Orders with a Conversion Date on or after the stated effective date. It will not retroactively reduce the commission applicable to a Qualifying Order with a Conversion Date before that effective date, although normal validation, return, refund, chargeback, fraud, and reversal provisions will continue to apply.

    An Affiliate who does not agree to a change may terminate participation before the change takes effect. Continued participation after the effective date constitutes acceptance of the revised Applicable Offer.

    20.3 Acceptance of Changes

    Continuing to participate after updated Terms take effect constitutes acceptance. An Affiliate who does not agree to a change must stop participating and terminate the account.

    20.4 Program and Product Changes

    JMB may change or discontinue:

    Products

    Prices

    Discounts

    Shipping destinations

    Product availability

    Promotional codes

    Brand Materials

    Platform features

    Campaigns

    The Program itself

    JMB does not guarantee continued availability of any product, commission structure, platform, or promotional method.

    21. REPRESENTATIONS, WARRANTIES, AND DISCLAIMERS

    21.1 Mutual Authority

    Each party represents that it has authority to enter into these Terms.

    21.2 Affiliate Warranties

    You represent and warrant that:

    Your application information is accurate

    Your participation does not violate another agreement

    Your content and promotional methods comply with law

    You have necessary intellectual-property and publicity rights

    Your disclosures are clear and sufficient

    Your statements are truthful and substantiated

    You will not engage in prohibited conduct

    You will comply with applicable platform rules

    21.3 Program Disclaimer

    To the fullest extent permitted by law, the Program, Brand Materials, affiliate links, tracking systems, dashboards, and related services are provided “as is” and “as available.”

    JMB disclaims implied warranties concerning merchantability, fitness for a particular purpose, uninterrupted operation, error-free tracking, or any particular level of earnings.

    This disclaimer does not alter any nonwaivable product warranty or customer right that applies directly to a customer purchase.

    22. LIMITATION OF LIABILITY

    To the fullest extent permitted by law, JMB and its owners, officers, employees, agents, service providers, and affiliates will not be liable for:

    Indirect damages

    Incidental damages

    Special damages

    Consequential damages

    Exemplary or punitive damages

    Lost profits

    Lost opportunities

    Lost data

    Lost goodwill

    Expected but untracked commissions

    Damages caused by platform outages, browser settings, payment-provider actions, or third-party services

    This limitation applies regardless of the theory of liability and even if the possibility of damages was known.

    Except for valid commissions actually owed under these Terms, JMB’s total aggregate liability arising from or relating to the Program will not exceed the greater of:

    $100; or

    the commissions paid or payable to the Affiliate during the 12 months immediately preceding the event giving rise to the claim.

    Nothing in this section excludes liability that cannot lawfully be excluded or limited. An attorney should confirm whether the proposed $100/12-month cap is appropriate for JMB.

    23. INDEMNIFICATION

    You will defend, indemnify, and hold harmless Waterglider LLC, J Mac Botanicals, and their owners, officers, employees, agents, affiliates, successors, service providers, and licensors from third-party claims, demands, proceedings, damages, judgments, liabilities, penalties, settlements, costs, and reasonable attorneys’ fees arising out of or relating to:

    Your breach of these Terms

    Your Affiliate Channels

    Your content or promotional activities

    A false, misleading, or unsubstantiated claim

    Failure to disclose the affiliate relationship

    Your violation of advertising, privacy, email, text-message, intellectual-property, consumer-protection, tax, or other law

    Your infringement or misappropriation of another person’s rights

    Your collection, use, loss, or disclosure of personal information

    Fraud, negligence, willful misconduct, or unauthorized activity by you or someone acting through your account

    A recipe, formulation, DIY instruction, or use recommendation you created without JMB’s written approval

    A representation, warranty, promise, or commitment you made without authority

    JMB will provide reasonable notice of a covered claim. JMB may control the defense using counsel of its choosing. You may not settle a claim in a manner that admits wrongdoing by JMB, imposes obligations on JMB, or restricts JMB without JMB’s prior written consent.

    24. EQUITABLE RELIEF

    Unauthorized use of JMB intellectual property, disclosure of Confidential Information, misuse of customer information, or continued prohibited promotion may cause harm that is difficult to measure through money damages alone.

    JMB may seek temporary, preliminary, or permanent injunctive relief or other equitable relief, in addition to other remedies, without being required to prove that monetary damages are inadequate or to post bond except where applicable law requires otherwise.

    25. DISPUTE RESOLUTION, GOVERNING LAW, AND VENUE

    25.1 Informal Resolution

    Before filing a lawsuit, a party should provide written notice describing the dispute and requested resolution. The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice.

    This requirement does not prevent either party from seeking immediate equitable relief or acting to preserve a legal deadline.

    25.2 Governing Law

    These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

    25.3 Exclusive Venue

    Any legal action arising from or relating to the Program or these Terms must be brought exclusively in:

    An appropriate state court located in Spokane County, Washington; or

    The United States District Court for the Eastern District of Washington, when federal jurisdiction exists.

    Each party consents to the personal jurisdiction of those courts and waives objections based on inconvenient forum or lack of venue.

    26. NOTICES

    26.1 Notices to the Affiliate

    JMB may provide routine Program notices through:

    The Affiliate’s Refersion dashboard

    The email address associated with the Affiliate’s account

    The registration page

    Another electronic method reasonably associated with the Program

    Notices are considered received when sent, unless JMB receives a delivery-failure notice.

    26.2 Notices to JMB

    Formal notices to JMB must be sent to:

    A formal notice concerning a dispute, indemnification demand, or alleged legal breach should be sent both by email and by a trackable mail or delivery method.

    26.3 Updated Contact Information

    The Affiliate must maintain a current email address, mailing address, and telephone number. Failure to review an account or email does not invalidate a properly sent notice.

    27. MISCELLANEOUS

    27.1 Entire Agreement

    These Terms, the applicable Refersion offer details, the Affiliate Program Privacy Notice, and any written campaign-specific terms constitute the entire agreement concerning the Program.

    They replace prior discussions or representations concerning the same subject.

    27.2 Order of Precedence

    If documents conflict:

    A specific written offer controls only concerning its commission rate, eligible products, bonus, or campaign period.

    These Terms control concerning general Program participation.

    General marketing or recruitment language does not override these Terms.

    Refersion, Unified Payments, and Dots terms independently govern their respective services.

    27.3 Assignment

    The Affiliate may not assign or transfer these Terms or the account without JMB’s prior written consent.

    JMB may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of control, or transfer of the Program.

    27.4 Force Majeure

    Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, fire, severe weather, war, terrorism, labor disruption, utility failure, internet failure, cyberattack, government action, supply-chain interruption, payment-system failure, or platform outage.

    This section does not excuse payment of a valid commission that has already become due and payable.

    27.5 Severability

    If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

    27.6 No Waiver

    Failure to enforce a provision does not waive the right to enforce it later. A waiver must be in writing and applies only to the specific matter stated.

    27.7 No Third-Party Beneficiaries

    Except for parties expressly protected by the indemnification and liability provisions, these Terms do not create rights for third parties.

    Refersion, Dots, and other service providers are not parties to this Agreement solely because their services are used.

    27.8 Headings

    Headings are provided for convenience and do not limit the meaning of a provision.

    27.9 Electronic Acceptance

    Electronic acceptance, dashboard acceptance, and continued Program participation have the same effect as a handwritten signature to the extent permitted by law.

    This Affiliate Program Privacy Notice explains how Waterglider LLC, doing business as J Mac Botanicals (“J Mac Botanicals,” “we,” “us,” or “our”), collects, uses, discloses, retains, and protects Personal Information in connection with the J Mac Botanicals Affiliate Program (“Program”).

    This Notice applies to people and businesses that apply to the Program, participate as approved affiliates, formerly participated in the Program, or communicate with us about the Program. It applies whether or not an application is approved.

    U.S.-Only Program Eligibility. The Program is open only to eligible applicants based in the 50 United States or the District of Columbia, as further described in the Affiliate Program Terms and Conditions. This Notice nevertheless applies to Personal Information submitted by anyone who applies, contacts us about the Program, or otherwise interacts with the Program, regardless of whether that person is eligible or approved.

    This Notice supplements the J Mac Botanicals Website Privacy Notice. The Website Privacy Notice continues to apply to an affiliate’s use of the J Mac Botanicals website as a visitor or customer. If the two notices conflict concerning Personal Information collected specifically for the Affiliate Program, this Affiliate Program Privacy Notice will control.

    1. WHO IS RESPONSIBLE FOR PERSONAL INFORMATION?

    J Mac Botanicals determines why and how Program-related Personal Information is used to review applications, manage affiliate relationships, administer the Program, validate referrals, calculate commissions, authorize payments, communicate with affiliates, protect the Program, and comply with legal obligations.

    We use Refersion to host the affiliate registration process and dashboard and to administer affiliate accounts, referral links, referral codes, clicks, conversions, commissions, and payment records.

    Refersion may process transaction and attribution information on our behalf. Refersion may also process certain Refersion account, Marketplace, security, support, and platform information for its own purposes under its own privacy notice.

    The Program uses Refersion Unified Payments. Refersion and its payment partner, Dots, may collect and process identity-verification, tax, financial-account, payment, and compliance information needed to establish payment eligibility and issue commissions. Their processing is also governed by their respective terms and privacy notices.

    Affiliates are independently responsible for Personal Information they collect through their own websites, email lists, social-media accounts, applications, or promotional activities. Affiliates must provide any notices, choices, and consents required by applicable law.

    2. WHAT IS PERSONAL INFORMATION?

    “Personal Information” means information that identifies, relates to, describes, or could reasonably be linked with an individual or household.

    Personal Information generally does not include information that has been aggregated, anonymized, or deidentified so that it cannot reasonably be associated with an individual.

    3. WHAT PERSONAL INFORMATION DO WE COLLECT?

    Application and Contact Information

    When someone applies to the Program, we or Refersion may collect:

    Applicants should not include medical information, government-identification numbers, financial-account information, passwords, or other sensitive information in free-text application responses.

    Account Information

    Refersion may collect and maintain:

    ·         Password and authentication information

    ·         Refersion account number or affiliate identifier

    ·         Account preferences

    ·         Login and account activity

    ·         Records of account changes

    Refersion manages affiliate login credentials. Affiliates should never send their passwords to J Mac Botanicals.

    Publicly Available Information

    When evaluating an application, we may review publicly available information associated with the website, blog, or social-media channel submitted by the applicant. This may include:

    ·         Public posts, videos, images, articles, or other content

    ·         Public follower or subscriber counts

    ·         General subject matter and audience focus

    ·         Publicly disclosed business information

    ·         Past promotional content

    ·         Information relevant to brand alignment and Program eligibility

    Technical and Usage Information

    Refersion and its service providers may automatically collect technical information when an applicant or affiliate uses the registration page, affiliate dashboard, or related services. This may include:

    ·         Internet Protocol address

    ·         Browser type

    ·         Device and operating-system information

    ·         Referring page or URL

    ·         Date and time of access

    ·         Login activity

    ·         Page or feature interactions

    ·         Error, security, and diagnostic logs

    ·         Information used to detect fraud or unauthorized access

    J Mac Botanicals has not enabled Google Analytics, Meta Pixel, or similar advertising or behavioral-analytics technologies on the affiliate registration page. Refersion and its service providers may still collect technical and usage information necessary to provide, secure, troubleshoot, and improve the Refersion platform.

    Program and Performance Information

    We and Refersion may collect or generate information relating to an affiliate’s participation and performance, including:

    ·         Affiliate account and identification numbers

    ·         Affiliate links, referral parameters, and approved promotional codes

    ·         Click and referral activity

    ·         Attributed orders and conversions

    ·         Order or transaction identifiers

    ·         Products included in attributed orders

    ·         Order amounts, discounts, and transaction status

    ·         Returns, cancellations, refunds, and chargebacks

    ·         Pending, approved, denied, reversed, or paid commissions

    ·         Commission and payout history

    ·         Program compliance records

    ·         Communications and support requests

    Some attributed transaction information concerns customers rather than the affiliate. It may nevertheless be associated with the affiliate’s account for attribution, commission, fraud-prevention, reporting, and dispute-resolution purposes.

    Unified Payments Information

    Affiliates who receive commissions through Unified Payments must complete Refersion and Dots onboarding. Depending on the affiliate’s tax status and the requirements of Refersion, Unified Payments, and their payment providers, Refersion or Dots may collect:

    ·         Legal name

    ·         Telephone number and telephone-verification information

    ·         U.S. address

    ·         Identity-verification information

    ·         Government-issued identification, if requested

    ·         Tax status and applicable tax forms

    ·         Taxpayer-identification information

    ·         Payment-account or payout-method information

    ·         Payment eligibility and verification status

    ·         Unified Payments Wallet and withdrawal information

    ·         Tax-reporting and payment records

    This information is generally submitted directly to Refersion or Dots. J Mac Botanicals may receive payment status, eligibility, tax-reporting status, commission, and accounting information but may not receive full copies of all identity, tax, or financial-account documents.

    Unified Payments affiliates must complete applicable identity verification, tax onboarding, and payment setup requirements before receiving payments.

    4. HOW DO WE USE PERSONAL INFORMATION?

    We may use Program-related Personal Information to:

    ·         Receive and evaluate applications

    ·         Verify applicant identity, location, eligibility, and legitimacy

    ·         Approve or deny applications

    ·         Establish and administer affiliate accounts

    ·         Determine whether an affiliate is an appropriate fit for the brand

    ·         Generate and manage affiliate links, codes, and promotion methods

    ·         Attribute qualifying referrals and transactions

    ·         Calculate, review, approve, deny, reverse, and report commissions

    ·         Administer Unified Payments

    ·         Maintain payment, accounting, and tax records

    ·         Communicate about applications, Program decisions, products, creative materials, promotions, payments, policies, and support matters

    ·         Review compliance with the Affiliate Program Terms and Conditions

    ·         Detect spam, fraud, self-referrals, misuse, or unauthorized conduct

    ·         Investigate returns, cancellations, chargebacks, and attribution disputes

    ·         Protect our customers, affiliates, website, accounts, and business

    ·         Measure and improve Program performance

    ·         Establish, exercise, or defend legal claims

    ·         Comply with tax, accounting, regulatory, and other legal obligations

    ·         Carry out another disclosed purpose with the applicant’s or affiliate’s consent

    Where applicable law requires a legal basis, we may process Personal Information as necessary to take steps requested by an applicant, perform our agreement with an affiliate, pursue legitimate business interests, comply with legal obligations, or act with consent.

    5. WHEN AND WITH WHOM DO WE DISCLOSE PERSONAL INFORMATION?

    Refersion

    Refersion hosts and administers the affiliate registration page, accounts, dashboards, attribution, conversion records, commissions, reports, and related Program functions.

    Dots and Unified Payments Providers

    Refersion, Dots, and applicable payment providers process identity, tax, compliance, payment, wallet, and payout information needed for Unified Payments.

    Ecommerce, Accounting, and Operational Providers

    We may use ecommerce, email, hosting, accounting, fraud-prevention, data-storage, information-security, and customer-support providers to operate the Program and our business.

    Professional Advisers

    We may disclose information to attorneys, accountants, auditors, insurers, consultants, and other professional advisers when reasonably necessary.

    Governmental and Legal Recipients

    We may disclose information when required by law, legal process, tax requirements, court order, or governmental request, or when reasonably necessary to protect rights, safety, property, customers, affiliates, or the integrity of the Program.

    Business Transactions

    Information may be disclosed or transferred in connection with a proposed or completed acquisition, merger, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

    At an Affiliate’s Direction

    We may disclose information for another purpose when the affiliate directs us to do so or provides valid consent.

    6. HOW DOES AFFILIATE ATTRIBUTION WORK?

    The Program uses a 90-day Attribution Window for qualifying link-based referrals.

    When a person visits the J Mac Botanicals website through an approved affiliate link, Refersion may record the affiliate identifier and related click, session, browser, cart, and transaction information. If that person completes a qualifying purchase within 90 days, the purchase may be attributed to the affiliate, subject to the Affiliate Program Terms and Conditions.

    Link attribution generally operates on a last-touch basis. If a customer clicks links belonging to multiple affiliates, the most recent qualifying affiliate-link click generally receives attribution.

    The 90-day Attribution Window applies to affiliate-link conversions. Other approved attribution methods, such as coupon codes, customer-email promotion methods, or product-level attribution, may operate differently and may not be subject to the same window.

    Refersion states that its link attribution does not technically rely on ordinary browser cookies. Successful link attribution generally requires the customer to use the same device and browser, outside private or incognito mode, with applicable browser data remaining intact.

    The Attribution Window determines whether a transaction qualifies for link-based attribution. It does not determine how long application, commission, payment, tax, accounting, fraud-prevention, or legal records are retained.

    7. HOW LONG DO WE RETAIN PERSONAL INFORMATION?

    We retain Program-related Personal Information only for as long as reasonably necessary for the purposes described in this Notice.

    Retention may continue for the period necessary to:

    ·         Review and document application decisions

    ·         Maintain an active affiliate relationship

    ·         Complete pending transactions and payments

    ·         Process returns, refunds, chargebacks, and reversals

    ·         Maintain accounting and tax records

    ·         Prevent fraud and Program abuse

    ·         Resolve disputes

    ·         Enforce the Affiliate Program Terms and Conditions

    ·         Comply with legal obligations

    ·         Establish, exercise, or defend legal claims

    Information relating to denied, ineligible, or withdrawn applications may be retained for a reasonable period to document the decision, prevent repeated fraudulent or ineligible applications, respond to questions, and comply with legal requirements.

    Refersion, Dots, and other service providers may retain information according to their own legal obligations and retention policies.

    When information is no longer reasonably necessary, we will delete, anonymize, or securely isolate it, subject to legal, accounting, backup, and technical limitations.

    8. HOW DO WE PROTECT PERSONAL INFORMATION?

    We use reasonable administrative, technical, and organizational safeguards designed to protect Program-related Personal Information from unauthorized access, acquisition, loss, misuse, alteration, or disclosure.

    These measures may include:

    ·         Limiting access according to business need

    ·         Using established technology and payment providers

    ·         Maintaining account and authentication controls

    ·         Using designated providers for identity, tax, and financial-account information

    ·         Monitoring for unauthorized or fraudulent activity

    ·         Maintaining appropriate internal procedures

    No internet transmission or electronic-storage system is completely secure. We cannot guarantee absolute security.

    Affiliates are responsible for protecting their passwords, email accounts, devices, payment accounts, and authentication credentials and should promptly notify J Mac Botanicals or Refersion of suspected unauthorized access.

    9. WHAT PRIVACY RIGHTS DO APPLICANTS AND AFFILIATES HAVE?

    Depending on applicable U.S. federal or state law and the applicant’s or affiliate’s state of residence, an individual may have the right to:

    ·         Confirm whether Personal Information is being processed

    ·         Request access to Personal Information

    ·         Request correction of inaccurate information

    ·         Request deletion of Personal Information

    ·         Receive a portable copy of certain information

    ·         Restrict or object to certain processing where applicable

    ·         Withdraw consent where processing is based on consent

    ·         Opt out of certain sales, sharing, targeted advertising, or profiling where applicable

    ·         Appeal the denial of a privacy request where applicable

    ·         Exercise privacy rights without unlawful discrimination

    These rights are not absolute. We may retain or continue to process information when permitted or required for payments, taxes, accounting, security, fraud prevention, contractual enforcement, legal claims, or other lawful purposes.

    Requests may be submitted using the contact information below. We may request information reasonably necessary to verify the requester’s identity and authority.

    An individual may authorize an agent to submit a request when permitted by applicable law. We may require proof of the agent’s authority and may also require the individual to verify their identity directly with us.

    Certain information is maintained independently by Refersion or Dots. A separate request to the applicable provider may be necessary for Refersion Marketplace, Unified Payments, identity-verification, tax, wallet, or payout information that the provider controls.

    10. U.S.-ONLY PROGRAM ELIGIBILITY AND DATA PROCESSING

    The J Mac Botanicals Affiliate Program is open only to applicants who meet the U.S.-based eligibility requirements stated in the Affiliate Program Terms and Conditions.

    J Mac Botanicals is located in the United States. Program-related Personal Information is processed through J Mac Botanicals, Refersion, Unified Payments, Dots, and other service providers used to administer, secure, and support the Program.

    The Program’s U.S.-only eligibility requirement determines who may participate in the Program. It does not necessarily mean that Personal Information will be stored or processed only within an applicant’s state of residence or exclusively within the United States. Refersion and other service providers may use personnel, systems, or subprocessors in other locations, subject to their applicable privacy notices, legal obligations, and contractual requirements.

    Applicants and affiliates should review the privacy notices and terms provided by Refersion, Unified Payments, Dots, and any applicable payment provider concerning information those providers collect or control independently.

    11. PROGRAM COMMUNICATIONS

    Applicants and affiliates may receive communications concerning:

    ·         Application status

    ·         Account administration

    ·         Program policies

    ·         Products and promotions

    ·         Creative materials

    ·         Commission and payment information

    ·         Security

    ·         Support requests

    Affiliates may unsubscribe from optional promotional communications through the unsubscribe instructions in the message. Unsubscribing from promotional messages will not prevent necessary administrative, transactional, payment, or security communications.

    12. AGE REQUIREMENT

    The Program is intended only for people who are at least 18 years old and legally capable of entering into the Affiliate Program Terms and Conditions.

    We do not knowingly accept applications from children under 18 years of age. If we learn that we have collected Personal Information from a child, we will take reasonable steps to delete it, subject to applicable legal obligations.

    13. CHANGES TO THIS NOTICE

    We may update this Notice to reflect changes in the Program, technology, service providers, legal requirements, or our information practices.

    The revised Notice will show an updated “Last Updated” date. When required by law or when a change materially affects affiliate rights, we may provide additional notice by email, through the affiliate dashboard, on the registration page, or through another appropriate method.
